B5. Office spaces

PGA SA would like to state that, in principle, granting the right of use, leasing or renting out business space and buildings situated within the limits of the Port of Gdansk does not require a public tender procedure. In accordance with art. 3 of the Act of 20 December 1996 on ports and harbours, granting the right of use, leasing or renting out, or - based on a different agreement - granting the right to use or derive benefits for a period longer than 10 years from property owned by the State Treasury, a local government unit or an entity administering a port or a harbour, located within the limits of ports and harbours, requires the approval of the competent minister in charge of the State Treasury, granted based on an administrative decision issued in coordination with the competent minister in charge of maritime economy. Agreements concluded in violation of the obligation to obtain approval will be deemed void.
