Demurrage Fees of Port of Gdansk Authority SA

 

This price list specifies the terms and conditions for ship demurrage in the port and ship demurrage fees. This price list was approved by Resolution No. 151/2014 of 30.04.2014 of the Management Board, amended by the decision of the Management Board of 21 March 2017, and forms a supplement to Resolution No. 26/2014 of 29.01.2014 of the Management Board.

 

§1

  1. Demurrage fees specified in this price list shall be levied on:
    1. ships entering the port solely for demurrage as stated the written notification of arrival submitted to the Port's Chief Dispatcher
    2. seagoing, harbour and inland navigation ships using wharf or jetty prior to the 12 hours preceding operational or commercial activity
    3. seagoing, harbour and inland navigation ships using wharf or jetty after the 4 hours following the completion of operational and commercial activity

  2. Demurrage fee shall be levied according to the ship's GT for each started day of demurrage as a net rate given in EUR.

  3. Fees shall be converted into the currency of payment according to the average National Bank of Poland exchange rate on the date of completion of using port infrastructure.

  4. In order to ensure correct calculation of demurrage fee, each vessel entering the port shall submit to the Port's Chief Dispatcher a written notification of arrival/departure according to the binding provisions of "Tariff for services of the Port of Gdansk Authority SA".

  5. In order to ensure correct calculation of ship demurrage time, the ship representative/agent shall submit to the Port's Chief Dispatcher a "Statement of Facts".

  6. At each time after the notification of arrival has been made by the ship's owner or representative/agent, the terms and conditions for demurrage and place of demurrage shall be determined by the Port's Chief Dispatcher.

  7. The basis for calculating demurrage fee shall be the relevant valid International Tonnage Certificate or valid ship safety certificate which shall be delivered to the Port of Gdansk Authority SA by the ship master or representative/agent.

  8. In case of disputes, ship data in Lloyd's Shipping Register applies.


§2

Demurrage fee for seagoing, harbour and inland navigation ships moored at the port quays, except for ships where provisions of 3 apply, shall be calculated based on the following rates and according to the ship's GT.

§3

Terms and conditions for demurrage of more than 5 days shall be specified in a separate agreement between the Port of Gdansk Authority SA and the ship's owner or representative/agent.

 

§4

The Port of Gdansk Authority SA shall not charge any demurrage fees on vessels relieved from port fees according to separate regulations, particularly the Act on Ports and Sea Harbours.

 

§5

This price list of demurrage fees becomes effective as of 1.05.2014.*


* excluding par. 4 which becomes effective as of 1 August 2014, as well as par. 1.1b and par. 2, which become effective as of 1 May 2017.
